1. Introduction
Welcome to MotionLab ("we," "our," or "us"). By accessing or using our website, services, and AI-powered tools (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Services. By using MotionLab, you confirm that you are at least 18 years of age. If you are under 18, you may only use the Services with the involvement and consent of a parent or legal guardian.
2. Service Description
MotionLab provides an AI-powered platform that allows users to generate videos and images based on text prompts and uploaded assets. The Services are provided "as is" and "as available." We reserve the right to modify, suspend, or discontinue any part of the Services at any time.
3. AI Generation & Content
Nature of AI: You acknowledge that our Services use Artificial Intelligence. AI generation is probabilistic and may produce erratic, inaccurate, or offensive results. MotionLab does not guarantee that the generated content will meet your specific expectations.
User Responsibility: You are solely responsible for the inputs (text prompts, images) you provide and the consequences of using the generated outputs.
Prohibited Content: You may not use MotionLab to generate content that is illegal, defamatory, sexually explicit (NSFW), promotes violence, creates "deepfakes" of real people without consent, or infringes on the intellectual property rights of others. We reserve the right to ban users who violate these guidelines.
Community Content: If you share your creations publicly via MotionLab's community features, you are responsible for ensuring the content complies with these Terms and does not violate the rights of others.
Post-Processing Effects: Certain features (such as the Boomerang effect and Studio editing tools) allow you to modify generated content client-side. These modifications are applied on your device and are your sole responsibility. MotionLab retains the original generated file and is not liable for any unintended results caused by post-processing effects.
Community Visibility: Content shared publicly via the Community feature is visible to all users of the platform, including unauthenticated visitors, and may be indexed by search engines. You are solely responsible for ensuring that any content you share publicly complies with these Terms.
4. Intellectual Property
Your Content: You retain ownership of the inputs you upload and the assets you generate using MotionLab, subject to these Terms.
License to Us: By using the Services, you grant MotionLab a non-exclusive, worldwide license to use, host, and process your inputs and generated assets solely for the purpose of providing and improving the Services.
Platform Rights: All software, design, code, and underlying technology of MotionLab are the property of MotionLab and are protected by copyright and other intellectual property laws.
5. Credits, Payments, and Refunds
Credits: Services are accessed via a credit system. Credits are purchased in advance and deducted upon usage.
No Refunds on Used Credits: Once credits are used to initiate a generation job, they are non-refundable, regardless of the artistic quality of the result.
Technical Failures: If a generation fails due to a technical error on our end (e.g., server crash), the credits will be automatically refunded to your account balance.
Content Moderation: If generated content triggers our safety filters (e.g., NSFW detection), credits used for that generation are non-refundable. This policy helps maintain platform integrity.
Price Changes: We reserve the right to change the pricing of credit packs at any time.
Account Termination & Credits: If your account is suspended or terminated for violating these Terms, any remaining credit balance is forfeited and will not be refunded.
6. Limitation of Liability
To the maximum extent permitted by law, MotionLab shall not be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with your use of the Services. Our total liability to you for any claim shall not exceed the amount you paid to us in the 12 months preceding the claim.
7. Content Storage & Retention
Generated files are stored on our servers for a period of 30 days from the date of creation. After this period, files that have not been explicitly saved by the user will be permanently deleted from our systems, including all cloud storage.
To permanently retain a generated file, users must mark it as a favorite by clicking the heart (♥) icon on the file in their dashboard. Favorited files are exempt from the 30-day deletion policy and will be retained indefinitely, or until the user deletes them manually.
MotionLab is not responsible for any loss of content that was not saved prior to the expiration of the 30-day retention period. It is the user's sole responsibility to save any content they wish to keep.
8. Termination
We reserve the right to suspend or terminate your account at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason.
9. Governing Law
These Terms shall be governed by and construed in accordance with the laws of Israel, without regard to its conflict of law principles.
