Terms of Service

1. The Service

MotionLab provides AI-assisted creative tools for generating, editing, transforming, and managing visual content, including images, videos, motion visuals, VJ loops, event visuals, 3D assets, chat-based motion design tools (such as Motion Studio), browser-based editing tools, and related creative outputs.

MotionLab may use proprietary workflows, custom-trained style systems, open-weight AI models, third-party AI models, external infrastructure providers, and internal rendering infrastructure to provide the Service. MotionLab may change, add, remove, limit, or replace models, workflows, providers, features, credit costs, generation limits, or availability at any time.

2. Accounts

You must provide accurate account information and keep your login credentials secure. You are responsible for all activity under your account, including generations, uploads, public sharing, credit usage, and activity by anyone who accesses your account.

If your account is issued API keys (for example, approved Enterprise API access), those keys are secrets. You must keep them confidential, must not share or publish them, and are responsible for all usage and charges made with them. API access is limited to the scopes, rate limits, and usage limits configured for your account, remains subject to these Terms and the Acceptable Use Policy, and may be revoked. Notify us promptly if you believe a key has been compromised.

We may suspend or terminate accounts that violate these Terms, our Acceptable Use Policy, payment rules, third-party model restrictions, or applicable law.

3. Credits, Billing, and Paid Features

MotionLab may use credits or other usage-based limits for generation and paid features. Credits may be consumed when a generation, edit, render, or processing job starts. The amount of credits required may depend on the selected tool, model, provider, duration, resolution, or other generation settings.

Credit prices, plan limits, free usage, promotions, model availability, and feature availability may change. Unless required by law or stated in our Refund Policy, used credits are not refundable merely because you dislike an output, made a prompt mistake, selected the wrong settings, uploaded the wrong asset, changed your mind, or expected a different creative result.

Some features (such as Motion Studio) may be offered with free daily usage limits, as beta or experimental features, and/or with an optional paid subscription. If you purchase a subscription, it renews automatically each billing period until you cancel. If you cancel, your paid access continues until the end of the period you already paid for and then does not renew. Free usage limits, subscription pricing, included models, and daily quotas may change, and beta features may change or be discontinued. Outputs you have already exported to your account are not removed because a subscription ends.

Payment processing may be handled by third-party payment providers or merchant-of-record services. Their terms may also apply.

4. User Inputs

“Inputs” include prompts, images, videos, masks, references, uploaded files, metadata, project files, style references, and any other material you submit to MotionLab.

You represent and warrant that you own or have all rights, licenses, permissions, and consents necessary to upload and use your Inputs with MotionLab. You must not upload or use Inputs that violate our Acceptable Use Policy or infringe copyright, trademark, or privacy rights. You are responsible for reviewing your Inputs before uploading them.

5. Outputs

“Outputs” are images, videos, 3D files, previews, edits, renders, generated assets, or other content produced by MotionLab from your use of the Service.

Subject to these Terms, your payment obligations, third-party rights, applicable law, and applicable model/provider restrictions, MotionLab does not claim ownership of your private Outputs. You are responsible for reviewing Outputs before using, publishing, selling, delivering to clients, displaying at events, incorporating into commercial work, or distributing them.

AI-generated Outputs may be inaccurate, unexpected, non-unique, similar to outputs generated for others, or legally unsuitable for certain uses. MotionLab does not guarantee that Outputs are original, exclusive, copyrightable, non-infringing, trademark-cleared, safe for all commercial uses, or suitable for any specific purpose.

6. Commercial Use

MotionLab is intended for creative and commercial workflows, subject to these Terms. You may use Outputs commercially only if your Inputs were lawful, your use doesn't infringe third-party rights, you comply with this Agreement, the Acceptable Use Policy, and you obtain any necessary likeness, model, brand, venue, or music releases.

7. Public Sharing and Community Features

MotionLab may allow you to publish, share, showcase, or make Outputs public. Private Outputs remain private unless you choose to publish or share them, or as described in the Service interface.

If you publish or share an Output publicly, you grant MotionLab a worldwide, non-exclusive, royalty-free license to host, display, reproduce, distribute, promote, and make that public Output available in connection with MotionLab (community galleries, share pages, promotional previews, etc.). 8. Acceptable Use

You must comply with our Acceptable Use Policy, which is incorporated into these Terms. You must not use MotionLab to create, upload, process, request, publish, or distribute illegal, harmful, exploitative, deceptive, infringing, abusive, non-consensual, or prohibited content.

9. Third-Party AI Models, Providers, and Infrastructure

MotionLab may use third-party AI models, open-weight models, APIs, GPU providers, cloud infrastructure, storage providers, authentication providers, payment providers, email providers, analytics providers, queue systems, and other subprocessors to operate the Service.

Some workflows may be subject to additional restrictions from third-party or open-weight AI model licenses. You agree not to use any model-powered workflow in a way that violates those restrictions. For notices, see our Third-Party Notices.

10. No Third-Party Endorsement

References to third-party models, providers, platforms, software, tools, or services do not imply sponsorship, endorsement, approval, partnership, or affiliation unless expressly stated. You may not represent that MotionLab or any MotionLab Output is endorsed by a third-party model provider, brand, artist, or platform.

11. Intellectual Property

MotionLab and its software, workflows, user interface, designs, branding, trade names, code, systems, documentation, and platform content are owned by MotionLab or its licensors and are protected by intellectual property laws. You may not copy, reverse engineer, scrape, resell, sublicense, interfere with, or misuse MotionLab except as allowed by these Terms.

12. Copyright and IP Complaints

If you believe content on MotionLab infringes your rights, contact us with enough information to identify the content, your rights, and the requested action. MotionLab may remove or restrict allegedly infringing content and may suspend repeat infringers. See our Copyright and IP Policy for details.

13. Privacy and Uploaded Assets

Our Privacy Policy and Uploaded Assets Privacy page explain how we collect, use, process, store, and share information, including account data, uploaded assets, prompts, generated outputs, logs, and provider processing.

14. Service Availability

MotionLab is provided on an “as is” and “as available” basis. Generation tools depend on model providers, GPU infrastructure, queues, storage, internet connectivity, and other systems that may fail, delay, degrade, or become unavailable. MotionLab does not guarantee uninterrupted service, generation success, or specific model availability.

15. Beta and Experimental Features

Some features may be experimental, beta, limited, internal, preview, or subject to change. Experimental features may produce unstable results, fail, change behavior, or be removed without notice.

16. Prohibited Technical Activity

You must not bypass rate limits, credit systems, safety controls, or usage limits; scrape, crawl, overload, or disrupt the Service; use automated systems to abuse promotions or queues; upload malware; or attempt to access other users' private library data.

17. Export Controls and Sanctions

You must not use MotionLab where prohibited by export controls, sanctions, trade restrictions, or applicable law. You represent that you are not a sanctioned person or entity or resident in a sanctioned jurisdiction.

18. Termination

You may stop using MotionLab at any time. MotionLab may suspend or terminate your access if you violate these Terms, fail to pay, create legal risk, abuse the Service, or violate provider restrictions.

19. Disclaimers

MotionLab does not provide legal, copyright, trademark, publicity-rights, privacy, or clearance advice. You are responsible for determining whether your Inputs and Outputs are lawful and suitable for your intended use.

20. Limitation of Liability

To the maximum extent permitted by law, MotionLab will not be liable for indirect, incidental, special, or consequential damages, including lost profits, lost data, failed event delivery, or loss of creative work. MotionLab's total liability will not exceed the amount you paid to MotionLab for the Service in the three months before the event giving rise to the claim.

21. Indemnity

You agree to defend, indemnify, and hold MotionLab harmless from claims, damages, liabilities, and expenses arising from your Inputs, your Outputs, your use of the Service, your violation of these Terms, or your commercial distribution of Outputs.

22. Changes to These Terms

MotionLab may update these Terms from time to time. Your continued use of MotionLab after changes become effective means you accept the updated Terms.
